Joseph Baumgarten is a partner and former co-chair of Proskauer’s Labor & Employment Law Department. He is highly regarded in the legal field, earning recognition from Chambers, US Legal 500, HR Executive Law Dragon, and Best Lawyers. He was also selected as one of the 2013 BTI Client Service All-Stars, an honor based solely on client nominations for outstanding service.
Joe represents both public and private employers in various areas of labor and employment law, including cases under the National Labor Relations Act, Title VII, ADEA, ADA, FLSA, WARN, and Sarbanes-Oxley. He also handles breach of contract disputes related to executive compensation. His work regularly involves:
- Defending employers in single and multi-plaintiff cases, class actions, and arbitrations before federal and state courts, administrative agencies, and arbitration bodies like FINRA, AAA, and JAMS;
- Representing unionized employers in collective bargaining, grievance arbitrations, and proceedings before the National Labor Relations Board;
- Advising employers on internal investigations, restrictive covenants, workforce reductions, restructurings, and labor issues connected to corporate transactions.
Joe’s practice spans numerous industries, and he has extensive experience working with employers in banking, insurance, brokerage, television, professional sports, newspapers, healthcare, trucking, and retail.
